The Website Makers Inc., operating as TheWebsiteMakers.ca (“TheWebsiteMakers”, “we”, “us” or “our”), is a federally incorporated web design, hosting and website care business based in Toronto, Ontario, Canada. This Privacy Policy explains what personal information we collect through this website and in the course of our business, how we use and protect it, and the choices and rights you have. It is written to meet Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial and U.S. state privacy laws.
By using this website or contacting us, you agree to the practices described here. If you do not agree, please do not use the website or send us personal information.
1. Who is responsible for your information
The Website Makers Inc. is responsible for personal information under its control. Our Privacy Officer oversees our compliance with this policy and can be reached at [email protected].
2. Information we collect
Information you give us. When you fill in a form, email us or become a client, we collect what you choose to share, such as your name, email address, phone number (optional), business name, the service you are interested in, details about your project and anything else you include in your message.
Information collected automatically. Like most websites, our web server records standard technical information when you visit, such as your IP address, browser type, device type, the pages you request and the date and time. We use it to deliver the website, keep it secure and troubleshoot problems.
Approximate location. To show prices in the right currency (US dollars in the United States, Canadian dollars elsewhere), the website looks up the country associated with your IP address. We use only the country for this purpose and do not store it with your identity.
Client information. If you become a client, we also collect billing and contact details, and we may have access to the content and data on websites we build, host or maintain for you. We handle that data only to provide our services, as described in our agreement with you.
What we do not collect. We do not use analytics or advertising tracking on this website, we do not buy personal information, and we do not knowingly collect information from children under 16.
3. Why we use your information
- To reply to your enquiry, prepare quotes and communicate with you
- To provide, bill for and support the services you purchase
- To protect this website, our clients and our systems from spam, fraud and abuse
- To meet our legal, tax and accounting obligations
- To send you information you have asked for. We only send marketing emails with your consent, as required by Canada’s Anti-Spam Legislation (CASL), and you can unsubscribe at any time
We collect only what we need for these purposes and will ask for your consent before using your information for any new purpose.
4. Who we share it with
We do not sell or rent personal information, and we do not share it for targeted advertising. We share it only with:
- Service providers who help us run our business, such as our website hosting provider, our email delivery service, Cloudflare (Turnstile spam protection on our forms, which may process your IP address and browser information), and Google Fonts (which receives your IP address when your browser loads our fonts). They may use your information only to provide their services to us.
- Professional advisers, such as our accountant or lawyer, where needed.
- Authorities, when required by law, or to protect our rights, our clients or the public.
- A buyer or successor, if our business is sold or reorganized, under equivalent privacy protections.
5. Where your information is stored
Your information may be stored and processed in Canada, the United States or other countries where our service providers operate. While it is outside Canada, it is subject to the laws of that country and may be accessible to its courts, law enforcement and national security authorities. We choose providers that protect personal information with safeguards comparable to ours.
6. How long we keep it
- Enquiries that do not lead to work: up to 24 months, then deleted
- Client records, contracts and invoices: for the length of our relationship and then as long as tax and legal requirements demand (in Canada, generally at least six years)
- Server security logs: generally up to 90 days
When we no longer need information, we delete it or make it anonymous.
7. How we protect it
We use reasonable physical, organizational and technical safeguards suited to the sensitivity of the information, including encrypted connections (HTTPS), access controls, strong authentication, software updates and security monitoring. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach of security safeguards creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as required by law.
8. Your rights and choices
Subject to legal exceptions, you can:
- Ask what personal information we hold about you and request a copy
- Ask us to correct information that is inaccurate or incomplete
- Ask us to delete your information, or withdraw your consent, where we are not required to keep it
- Unsubscribe from marketing emails at any time
Residents of Quebec and of U.S. states with consumer privacy laws may have additional rights, such as data portability or the right to opt out of certain processing. We do not sell or share personal information for cross-context behavioural advertising. To make a request, email [email protected]. We may need to confirm your identity, and we will reply within 30 days.
If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada or your local privacy authority.
9. Links to other websites
Our website, including our portfolio and blog, links to websites we do not control. Their privacy practices are their own; please read their policies.
