Terms of Service

Last updated: October 19, 2026

These Terms of Use (“Terms”) govern your use of thewebsitemakers.ca (the “website”), operated by The Website Makers Inc., a corporation incorporated under the Canada Business Corporations Act and doing business as TheWebsiteMakers.ca (“TheWebsiteMakers”, “we”, “us” or “our”). By using the website you agree to these Terms. If you do not agree, please do not use the website.

1. Our services are covered by a separate agreement

These Terms cover the website only. Any website design, development, hosting, care plan, accessibility or other service we provide is governed by a written proposal, quote or service agreement signed or accepted by both parties, together with our Service Level Agreement where it applies. If those documents conflict with these Terms, the service documents prevail.

2. Prices, quotes and plans

Prices on the website are in Canadian dollars for visitors outside the United States and in US dollars for visitors in the United States, are shown before applicable taxes, and, where marked “from”, are starting prices. Prices, plans and features may change at any time. Information on the website is not an offer that you can accept: an order is only binding once we confirm it in a written quote or agreement. We may decline any work at our discretion. Any discount, including multi-site discounts, applies only when confirmed in writing.

3. Information only, not professional advice

Our website content, including our blog and our pages about accessibility laws such as the AODA and the ADA, is general information provided for convenience. It is not legal, financial, tax or other professional advice, it may not reflect the latest changes in law or technology, and it may not suit your situation. Always consult a qualified professional, such as a lawyer, before making decisions. We are web professionals, not lawyers, and our accessibility work does not guarantee that you will not face complaints or legal claims.

4. Acceptable use

You may use the website for lawful purposes only. You must not:

  • Attempt to gain unauthorized access to the website, its server or any connected system
  • Introduce malware or interfere with the website’s operation or security
  • Scrape, copy or harvest content or data by automated means without our written permission
  • Send spam, false information or unlawful content through our forms
  • Use the website in any way that infringes others’ rights or breaks the law

We may block access to anyone who breaks these rules.

5. Intellectual property

The website and its content, including text, design, graphics, logos and code, are owned by us or our licensors and are protected by copyright and trademark laws. You may view and print pages for your personal, non-commercial use and quote brief excerpts with a credit and link to us. Any other use requires our written permission. Client logos, names and screenshots in our portfolio belong to their owners and are shown with reference to work we performed or to their publicly available websites. Other product names and trademarks mentioned on the website belong to their owners and do not imply endorsement.

6. Third-party links and services

The website links to other websites and uses third-party services. We are not responsible for their content, availability or practices, and a link is not an endorsement.

7. Submissions

When you send us information through the website, you confirm that it is accurate and that you have the right to share it. Our use of personal information is described in our Privacy Policy.

8. No warranties

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the website will be uninterrupted, error-free or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, TheWebsiteMakers and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising out of or related to your use of, or inability to use, the website or its content, even if advised of the possibility of such damages. Our total liability for any claim relating to the website is limited to CAD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; in that case our liability is limited to the smallest amount permitted by law.

10. Indemnity

You agree to indemnify and hold harmless TheWebsiteMakers and its owners, employees and contractors from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the website.

11. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree that the courts located in Toronto, Ontario have exclusive jurisdiction over any dispute relating to the website or these Terms, except where the law of your place of residence gives you a right that cannot be waived. Before starting any legal proceeding, you agree to contact us first and try in good faith to resolve the issue.

12. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the website. We may update these Terms at any time by posting a new version here; continued use of the website after a change means you accept it.
